Seller Terms and Conditions Agreement

Effective Date: 11th January 2025

1. Introduction

This Seller Agreement ("Agreement") outlines the terms and conditions governing the relationship between SalaamGCC and the Seller. By registering and listing products or services on SalaamGCC, the Seller agrees to comply with all terms herein, as well as SalaamGCC's general Terms of Use and applicable local consumer protection laws.

2. Role of SalaamGCC

SalaamGCC acts as an online marketplace platform that connects sellers and buyers. The Platform facilitates listing, marketing, and payment processing but does not act as a direct buyer or seller of goods or services. The Seller remains fully responsible for product quality, shipment, and customer satisfaction.

3. Seller Responsibilities

The Seller agrees to:

  • Ensure all listed products are accurate, genuine, and lawfully owned.
  • Deliver the product within the promised time frame and to the correct customer address.
  • Provide a valid tracking number or delivery proof (where applicable).
  • Respond promptly to any customer or SalaamGCC inquiries.
  • Comply with all local and GCC trade, tax, and consumer protection laws. Failure to fulfill these responsibilities may result in suspension or permanent removal from the Platform.

4. Payment and Disbursement Policy

  • Payments for completed orders will be held in escrow by SalaamGCC until the buyer confirms receipt of the correct product.
  • Disbursement to the Seller will occur 15 days after customer confirmation, provided no disputes or complaints are raised.
  • In the event of a customer dispute, SalaamGCC reserves the right to withhold payment until the matter is resolved.
  • Payment will be made to the Seller's registered bank or crypto wallet account as provided in the Seller Dashboard.

5. Returns, Refunds, and Disputes

  • Customers have the right to raise complaints or return requests within the specified return period (if applicable under local law).
  • The Seller must honor all valid return or refund claims in accordance with consumer protection regulations.
  • If a customer reports receiving the wrong, defective, or counterfeit product, SalaamGCC reserves the right to deduct the refund amount from the Seller's pending payments.
  • Any dispute unresolved between the Seller and the buyer may be escalated to SalaamGCC's dispute resolution team or, if necessary, the Consumer Protection Department or Consumer Court under the applicable jurisdiction.

6. Consumer Rights and Legal Compliance

  • Sellers must respect and comply with GCC and local consumer rights laws, including the right to accurate product information, timely delivery, and refund in case of non-compliance.
  • SalaamGCC and the Seller both acknowledge that consumers have the right to file complaints with the Consumer Court or relevant regulatory body in case of unfair trade practices or violation of consumer rights.
  • SalaamGCC will cooperate with any legal authority in investigations related to consumer disputes or fraud.

7. Prohibited Products

The Seller shall not list or sell items that are illegal, restricted, counterfeit, or prohibited under GCC or local law. SalaamGCC reserves the right to immediately remove such listings and suspend the Seller's account.

8. Limitation of Liability

SalaamGCC shall not be liable for:

  • Any loss or damage arising from product quality, late delivery, or misrepresentation by the Seller.
  • Any indirect, incidental, or consequential damages.

The Seller agrees to indemnify and hold SalaamGCC harmless from all claims, liabilities, and damages resulting from the Seller's actions or omissions.

9. Termination

SalaamGCC may suspend or terminate a Seller's account without notice if:

  • The Seller violates these Terms, or
  • Engages in fraudulent, misleading, or unlawful activities.

Pending payments may be held until all disputes are resolved.

10. Governing Law and Jurisdiction

This Agreement shall be governed by and construed in accordance with the laws of the United Arab Emirates (or the country in which SalaamGCC operates its regional entity). Any disputes arising hereunder shall be subject to the jurisdiction of the Consumer Court or competent civil court within that region.

11. Acceptance

By registering and listing products on SalaamGCC, the Seller acknowledges that they have read, understood, and agreed to the terms stated in this Agreement.
